By using the SD Media website (the "Service"), or any services provided by the parent company Top Gun Holdings CO d/b/a Schoneke Digital Media, you agree to be bound by the following terms and conditions ("Terms of Service").
Top Gun Holdings CO reserves the right to update and modify these Terms of Service from time to time without prior notice. Any new features, tools, or resources that augment or enhance the current Service shall be subject to these Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
1. Account & Partnership Terms
- You must be 18 years of age or older to use this Service or engage in strategic agency partnerships.
- You must provide your legal full name, a valid business email address, and any required information requested to complete the onboarding or audit process.
- Your login or access portal credentials may only be used by one designated individual - shared logins across unauthorized third parties are strictly prohibited.
- You are responsible for maintaining the security of your account, credentials, and integration keys. Top Gun Holdings CO cannot and will not be liable for any loss or damage from failure to comply with security obligations.
- You are responsible for all content posted and activity conducted under your account or client workspace.
- You may not use the Service for any illegal or unauthorized purpose, nor violate any applicable laws in your jurisdiction (including but not limited to copyright and privacy laws).
2. Billing & Professional Engagement Terms
- Professional services and managed retainer plans are billed in advance on a monthly or scheduled milestone basis according to your custom Master Services Agreement (MSA).
- All fees are exclusive of all federal, state, or local taxes, levies, or duties imposed by taxing authorities. Clients are responsible for payment of all such applicable taxes.
- Downgrading or modifying service scopes may adjust functional capacity or reporting access. Top Gun Holdings CO accepts no liability for loss of non-retained features resulting from plan adjustments.
3. Cancellation & Termination
You may request account or service cancellation at any time by contacting your assigned account team or submitting a request through our online Contact Form. Your engagement is considered canceled upon receipt of a written confirmation from the SD Media leadership team.
Top Gun Holdings CO, in its sole discretion, reserves the right to suspend or terminate accounts and refuse current or future use of the Service for any violation of these Terms of Service or ethical compliance standards.
4. Modifications to Service & Pricing
Top Gun Holdings CO reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with reasonable notice.
Prices for all Services, including monthly retainer fees and automation integration packages, are subject to change upon 30 days written notice from us.
5. Copyright & Content Ownership
All content provided by clients remains the intellectual property of the client. SD Media claims no ownership over proprietary business materials uploaded or provided for optimization.
The overall visual design, proprietary AI workflow schemas, code frameworks, and branding elements of the SD Media platform are copyright © 2008-2026 Top Gun Holdings CO. All rights reserved. You may not duplicate, copy, or reuse any portion of the frontend code, visual design elements, or underlying system architecture without express written permission.
6. General Conditions & Limitation of Liability
Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis. Technical support is provided directly to active clients via email and designated strategy channels.
You understand that Top Gun Holdings CO utilizes enterprise cloud infrastructure, high-availability hosting partners (including Vercel and Sanity CMS), and security providers to deliver performance.
In no event shall Top Gun Holdings CO be liable for any indirect, incidental, special, consequential, or exemplary damages resulting from the use or inability to use the service, unauthorized access, or statements of third parties.
